Under the bill, a small employer is one with an average of 2-50 employees (previously an average of 1-100 employees). Existing law requires the Commissioner of the Department of Insurance to grant a small employer a waiver of this requirement if the employer shows that it has caused an increase in premium costs of 2.5% or more.
