This bill is largely targeted towards online providers of clear orthodontic aligners such as SmileDirectClub. Under the bill, clear aligners (which are similar to braces) are now classified as a "medical device" and can't be provided to an individual unless they undergo an in-person examination by a dentist, receive dental x-rays, and are provided a prescription for their usage by a dentist. Oppose is the Limited Government Position as this measure represents one of the worst examples of cronyism and utilization of government power to stifle competition under the guise of "consumer protection". This protectionism merely enriches orthodontists and dentists and prevents the free market from expanding competition and lowering costs for consumers. Unfortunately, perhaps due to similar attacks in other states, SmileDirectClub was forced into bankruptcy and shutdown on December 21, 2023.

Expanding Government Power in the Orthodontics Industry to Shutdown Competition by Online Providers of "Clear Aligners" such as SmileDirectClub.

This bill prohibits state and local governments from imposing COVID-19 vaccine or mask mandates or from ordering private businesses or public or private schools to close for the purpose of stopping the spread of COVID-19. The bill does contain some exceptions for jails, hospitals, and other facilities where other rules conflict. Support is the Limited Government Position as this measure helps protect individual liberties by ensuring it is individuals - not government - making the medical decision on whether or not to receive a vaccination against COVID-19. Additionally, the bill protects against overreaching government mandates related to masks and shutdowns.

Protecting Individual Liberties by Prohibiting Government-Imposed COVID-19 Vaccine or Mask Mandates.

This bill allows cities which have a municipal street sales tax to call an election to authorize the tax for a period of 8 to 10 years if a majority of voters approved the tax in the last 2 elections. In most cities, the duration of the tax is limited to 4 years. Additionally, the bill expands the permitted uses of the tax to include not only maintenance and repair of streets and sidewalks, but now also water, wastewater, or stormwater systems located under a city street. Oppose is the Limited Government Position as this bill reduces government and fiscal accountability by weakening the ability for voters to properly scrutinize the usage of the funding and need for the taxation.

Reducing Government and Fiscal Accountability by Allowing Municipal Tax Levies to Continue for up to 10 Years (Previously 4 Years) without Voter Approval.

This bill provides for the suspension or removal of judges for "persistent or wilful" violations of the laws relating to setting bail. The bill is largely in response to "reform-minded" judges (typically receiving financial support from George Soros) who refuse to impose bail or set it at low levels. This bill prohibits local governments from utilizing public funds to hire a lobbyist to lobby state legislators or pay a state association that does so. The bill does provide an exception for legislation related to the military, service members, or veterans. The bill also creates the Texas Semiconductor Innovation Fund to provide grants to state government entities and semiconductor manufacturing and design companies in the state "to encourage economic development." Oppose is the Limited Government Position as not only does this measure further grow the size of government and central planning, but also worsens corporate welfare and cronyism by providing competitive advantages to select industries and businesses at the expense of taxpayers. Additionally, this bill is on top of other federal spending programs for the industry, such as the CHIPS and Science Act which provided $52.7 billion for "semiconductor research, development, manufacturing, and workforce development."

Worsening Cronyism and Government Central Planning by Creating the Texas Semiconductor Innovation Consortium to Enrich Certain Companies.

This bill expands the Rural Veterinarian Incentive Program, which provides taxpayer-funded loan repayment to veterinary students and recent graduates who agree to work in counties with populations below 150,000. Previously, eligibility was limited to counties with populations below 100,000. Oppose is the Limited Government Position as the free market - not central planning by politicians - is the best mechanism to determine the need and distribution of veterinarians across the state. Taxpayers in urban areas should not be forced to subsidize the amenities of individuals who choose to locate in rural or other portions of the state where veterinarians may not be as accessible.

Providing Significant Regulatory Relief to Car Owners by Eliminating the State's Mandatory Annual Vehicle Safety Inspection.

This bill makes it easier for movie production companies to receive a grant under the moving image industry incentive program by reducing the percentage of production crew, actors, and extras who must be Texas residents from 70% to 55%. This bill, the Fiscal Years 2024-2025 Operating Budget, represents a 21.3% increase over the prior budget, and the largest in state history. Some of the major new and increased spending initiatives within the bill include $1 billion for land acquisition for parks (3603.7% increase over the $27 million appropriated in the previous budget), an additional $100 million for the Texas Water Development Board Economically Distressed Areas Program, and $45.9 billion for business and economic development (25.8% increase). This bill establishes 10-year mandatory minimum sentences for individuals convicted of human smuggling and 5-year mandatory minimum sentences for operating a stash house (10 years if in an area subject to a declared state of disaster). The bill also enhances penalties for property damage that occurs as a result of concealing or harboring a person in the country illegally from a misdemeanor to a third-degree felony (2-10 years in prison). This bill amends the existing state law which prohibits firearms on school grounds or buildings when a school-sponsored activity is taking place. Under this bill, the "gun free zone" only applies to the actual premises owned by a school (not off-campus locations). For example, the bill imposes price controls which prevent a dealership from charging a customer a higher sales price if a buyer utilizes a third-party lender or offers cash. The bill is primarily directed at dealerships which offer discounts or condition vehicle sales on financing through preferred lenders. Imposing Price Controls and New Government Mandates on Automobile Dealerships Pertaining to Vehicle Financing.

This bill imposes a series of new insurance mandates requiring automobile insurance policies offered in the state provide coverage for original equipment manufacturer (OEM) parts as opposed to less costly aftermarket parts. The bill applies to all policies covering vehicles 36 months old or newer. Additionally, the bill forbids policies from restricting the repair facility or persons performing repairs. The bill also allows the attorney general to fine any governmental entity $1,000 for submitting a bad faith request for an opinion, and an additional $500 each day until the requested information is provided to the requestor. This bill establishes a series of new regulations which prohibit all insurance companies operating in the state from establishing their own policies concerning Environmental, Social and Governance (ESG). The new mandate and price control apply to both the coverage decisions of insurers as well as their rate setting practices. Oppose is the Limited Government Position as this government intrusion into the marketplace infringes the right of private insurance companies to set their own policies and coverage decisions. Instead of weaponizing government, lawmakers should instead work to reduce regulations and expand competition so the free marketplace can better reward and punish insurers based on the policies they enact.

Imposing Overreaching New Regulations on the Insurance Industry by Banning Private Companies from Setting their own Policies Surrounding ESG.

This bill allows the state's attorney general to prosecute certain crimes, including election, bribery, abuse of office, human trafficking, and abortion-related offenses, if a local prosecutor refuses to prosecute the case. Under the bill, when law enforcement agencies report probable cause to a local prosecutor for these offenses, they must also provide the information to the attorney general, who may prosecute the case if the local prosecutor does not prosecute the case within six months. The bill is largely in response to localities across the nations whose prosecutors (typically receiving financial support from George Soros) refuse to enforce or prosecute certain categories of crime. Unfortunately, this bill is especially necessary due to many so-called criminal justice "reforms" which have led to skyrocketing crime rates and are being advanced in state legislatures by George Soros and other radical-left billionaires through their funding of advocacy organizations on both sides of the political aisle.

Strengthening Law and Order by Permitting the State Attorney General to Prosecute Certain Crimes if Local Prosecutors Refuse.

The bill prevents localities from imposing additional regulations on farmers and ranchers engaging in agricultural operations. Under the bill, the Texas A&M AgriLife Extension Service is directed to develop a list of "generally accepted agricultural practices" that do not pose a threat to public health, which cities also may not prohibit or restrict. Support is the Limited Government Position as this bill strengthens property rights by combatting overreaching local regulations. While some may argue this bill undermines "local control", our founding fathers only recognized three entities within the U.S. Constitution - federal government, state government, and the individual. It is not the role for any level of government to unduly infringe the rights of individuals, therefore making preemption measures, such as this bill, necessary.

Protecting Farmers from Government Overreach by Preventing Local Governments from Imposing Additional Regulations on the Agricultural Industry.

This bill bans the sale or use of so-called "grinch bots" designed to automatically make purchases from websites, often in excess of quantity limitations, disguise the identity of the purchaser, or avoid security measures. These "bots" often make online retail purchases online faster and in larger quantities than a user would be able to, usually intended to allow resale of the items at a profit. Oppose is the Limited Government Position as the private sector - certainly not state government - is best equipped to handle and create counter-measures for issues surrounding "bots". If issues surrounding "bots" do reach a level where there is a role for government involvement (such as to prevent fraud or theft) then the federal government is much better equipped to handle such online threats that may come from individuals in other states or worldwide.

Growing Government Interference in the Private Marketplace through an Overreaching Ban on "Grinch Bots" for Online Sales.

This bill establishes a new regulatory framework for electric vehicle chargers under the Texas Department of Licensing and Regulation. Under the bill, most electric vehicle chargers made available to the public for a fee must be registered with the state and are subject to inspections, fee disclosures, and maintenance standards. Additionally, the Texas Commission of Licensing and Regulation is empowered to establish rules and impose fees to cover administrative costs. Oppose is the Limited Government Position as this bill further grows government power and the regulatory state. This measure will increase costs to electric vehicle owners as the fees charged by the commission will be passed along in the form of higher rates and surcharges.
